Description of Mark | The mark consists of the three dimensional product configuration as shown by the stippling of the upper of the popular Jungle Moc casual shoe, for which the following primary features are claimed: (a) Form Fitting Appearance. The upper includes a forefoot portion that tapers to a wider profile as it transitions from the toe toward the arch, with the lateral side of the forefoot appearing to widen at a greater rate than the medial side of the forefoot. The forefoot portion also tapers to a greater profile in height when viewed from the side as it transitions from the toe toward the arch, generally following the height contour of the wearer's foot. The tapered transition in both width and height from toe to arch gives the upper a form fitting appearance. (b) Flap Elements. The upper includes flap elements on either side of the tongue, created by the stitching running length-wise along the sides of the tongue. (c) Visible Stitching adjacent to Twin Gores and Flap Elements. Visible stitching is adjacent to the lower portions of the twin gores adjacent to both sides of the tongue, as well as along the flap-like elements of the tongue, to form a "V" shape. (d) Curved Stitching Designs. Twin curved visible stitching designs transition from the tongue forward on both sides of the forefoot portion down to the outsole. (e) Visible Stitching bordering Ankle Collar. Visible stitching borders an ankle collar that begins near each of the twin gores and transitions rearward to the heel. The visible stitching transitions to a heel portion and continues around the heel in the rearmost portion of the upper, joining the stitching on the opposite side of the upper. The visible stitching bordering the ankle collar also appears to transition to the tongue by way of visible stitching across the tongue which generally is aligned with the collar stitching. (f) Visible Stitching on Heel Loop. The visible stitching bordering the ankle collar transitions across the heel loop and joins the stitching on the opposite side of the upper. (g) Heel Counter. Visible stitching below the ankle collar in the rearmost portion of the upper forms a portion of a heel counter around the heel of the footwear. An outsole is shown in broken lines for purposes of illustration only and forms no part of the claimed footwear upper design. Broken lines also depict the tongue, twin gores, ankle collar, and heel loop which are shown for purposes of illustration only and form no part of the claimed design. The dashed lines appearing on the upper and described in (c), (d), (e), (f) and (g) above, representing visible stitching, are part of the claimed trade dress. |
