Description of Mark | The mark consists of the following-described color scheme and placement of colors used as trade dress with Applicant's portable fabric-covered structures: The main structures are white with a wide orange stripe running lengthwise along the top of each structure from one end to the other; the end panels on both ends of the main structures are blue. Certain of the main structures also have a blue end section. When the blue end section of such a structure is connected end-to-end with a main structure that does not have a blue end section, the effect is a single long white structure with blue end panels, a wide orange stripe running lengthwise along the top, and a wide blue band bisecting the structure and the orange stripe. The vestibules, namely, structures used to connect a main structure to another, or as entries, are blue with the following described three-bar design on the exterior-facing sides of the vestibules. The three-bar design consists of three stripes or bars, each of equal length, stacked horizontally. The top and bottom stripes are white. The middle stripe is orange. The stripes of the three-bar design do not run the full width of the side panel on which they are shown, but are centered vertically and horizontally on the side of the vestibule. When the main structures are connected end-to-end as described above and then arranged side-by-side and connected by a vestibule with similarly connected structures, the bisecting blue bands align with the connecting vestibules to create a continuous blue stripe running from a main structure to the vestibule to the next main structure perpendicular to the orange stripes on the structures. Broken lines in the Applicant's drawing serve only to show the placement of the mark on Applicant's portable fabric-covered structures. |
